NCW Releases Handbook on Inquiry Procedure Under POSH Act

The National Commission for Women (NCW) has released the Handbook on Inquiry Procedure for Internal Committee and Local Committee under the POSH Act, providing practical guidance on the conduct of inquiries under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

The handbook is intended to support Internal Committee (IC) members, Local Committees, employers, HR professionals, and other stakeholders involved in implementing the POSH Act. It explains the inquiry process in a structured and easy-to-understand manner while reinforcing the importance of following the principles of natural justice and procedural fairness.

What the Handbook Covers

The publication provides guidance on several important aspects of the inquiry process, including:

  • The roles and responsibilities of Internal and Local Committees.
  • How to handle a complaint after receiving it.
  • Timelines prescribed under the POSH Act.
  • Conducting inquiries while maintaining confidentiality.
  • Preparation of inquiry reports and recommendations.
  • Flowcharts and frequently asked questions to assist committee members.

The handbook also refers to the POSH Act, POSH Rules, and applicable service rules, making it a valuable reference for committees handling complaints.

Why It Is Relevant for Organizations

An effective Internal Committee depends on a clear understanding of the legal process. Procedural lapses can compromise the fairness and validity of an inquiry.

The NCW  POSH handbook provides practical guidance that can help committees conduct inquiries with greater clarity, consistency, and confidence. It also serves as a valuable resource for both newly constituted and experienced Internal Committee members.

The Role of Capacity Building

While reference materials are valuable, regular training remains equally important. Internal Committee members should receive periodic training to stay updated on legal developments, inquiry procedures, documentation, and judicial interpretations under the POSH Act.

At POSH INDIA, we regularly conduct POSH Awareness Programs, Internal Committee Capacity Building Workshops, and Inquiry Skills Training to help organizations strengthen their compliance framework and ensure that inquiries are conducted in accordance with the law.
